the Executive Council should not be called together immediately. I surmise that this suggestion is not unconnected with the difficulty which arises in regard to Sir R. Kotewall, and which is referred to in paragraph 4 of my minute of 12/3 above. There was, however, no opportunity this morning for discussion, and I understand that Brig. MacDougall is likely to make further recommendations in the light of Sir Mark Young's wishes. It is understood from Mr. Hastings that there would be no legal difficulty in not assembling the Executive Council, though I would think there would be considerable political difficulty if such a course were adopted for any length of time. On my understanding of the issue, however, Sir Mark Young's proposal merely is that as the necessary Ordinances would be drafted and ready to be passed by the Legislative Council on the day of the Governor's return and as therefore the Executive Council would not be necessary in that connection,

Sir Mark Young wishes to avoid calling them and so avoid the Kotewall difficulty on the day of his return.
